Personal Injury FAQs

You've got questions after your injury? We have answers.

How Do I Know if I Have a Personal Injury Case?

You might have a personal injury case if:

  • You were injured because someone else was negligent (e.g., rear-ended by a distracted driver)
  • Someone else intentionally hurt you (e.g., assault)
  • A defective or dangerous product contributed to an injury
  • A medical professional was careless or made a mistake while treating you
  • You suffered injuries on someone else’s premises (e.g., you slipped and fell on a broken floorboard), or
  • You suffered injuries while working.

Can you prove that someone else was negligent or strictly liable?

If someone acted without exercising reasonable care and you’ve suffered some type of damages as a result such as:

  • Physical injuries,
  • Emotional distress,
  • Monetary costs

Call our law firm for a free case evaluation now.

What Damages are Subject to Compensation in a NY Personal Injury Case?

In New York, you can seek both economic and non-economic awards for your injuries. These help to cover your financial costs, as well as compensate for hard-to-value trauma.

Potential compensation can include:

  • Medical bills (present and future)
  • Loss of wages and income
  • Disability
  • Rehabilitation and therapy
  • Property damage
  • Loss of enjoyment of life
  • Pain and suffering
  • Disfigurement, and
  • Funeral and burial expenses.

Punitive damages could be available if the defendant’s actions are deserving of punishment. These often apply in cases involving gross negligence, recklessness, or intentional misconduct.

What is the Personal Injury Claims Process?

It begins when you submit a claim to an insurer. This will likely be the insurance company for the party that caused your injury. However, you might submit a claim with your own insurer after a car collision through your no-fault coverage.

After you submit your claim, the following will occur:

  • The insurance agency will assign an adjuster to review your claim.
  • The adjuster may ask you for more information, including medical records, photographs of the wreck scene, etc.
  • The adjuster will review your claim and determine whether the insurer is liable.
After this, the insurance provider will do one of two things: (1) accept liability and propose a settlement agreement; or (2) deny liability and reject your claim.

If they accept liability, they may offer you a settlement that doesn’t fully cover your impairments. You and your personal injury lawyer will have the opportunity to negotiate a higher settlement. If the insurer denies your claim or refuses to offer a fair settlement, you may have to initiate a lawsuit to pursue your compensation.

What Is a New York Personal Injury Case Worth?

It depends on a lot of different factors.

  • Why types of injuries did you suffer?
  • How severe are they?
  • Did you contribute to your incident in any way?
  • What are your out-of-pocket expenses?
  • What kind of fees will you have in the upcoming time because of your injury?
  • Will you be able to return to your job? Did you have any loss of salaries?
  • How has the situation affected your quality of life?

The more serious your injuries, the more your case is probably worth. But, this is just a general rule. The pain and suffering that can accompany even a relatively minor injury can add considerable value to a case.

When you hire an attorney, they’ll carefully analyze your damages, consider how your injuries will affect you in the future, and consult with experts to value your case properly.

How Much Does it Cost to Hire a Personal Injury Lawyer in Manhattan?

Nothing upfront. This gives you the opportunity to ask for help without having to worry about the price. Personal injury lawyers work on contingency. They only get paid if they win your case.

If your case is successful, they will recover a pre-agreed-upon percentage of your award. This is typically anywhere between 33 and 40%.

How Long Do I Have to File a New York Personal Injury Lawsuit?

Three years. That’s the statute of limitations in New York for most personal injury lawsuits in the state. If you’ve lost a family member in a fatal case, then you’ll have a maximum of two (from their date of death) to file a wrongful death lawsuit against those responsible.

You will lose the right to get compensation if you miss the deadline that applies to your case. Speak with a lawyer to make sure that procedural rules don’t stand between you and the reimbursement you need.

What is Negligence?

Negligence means that a person caused another person to get hurt. This person failed to act reasonably under the circumstances and, as a result,

Negligence is the most common cause of action for many personal injury lawsuits. These include those involving auto accidents, slips and falls, medical malpractice, and wrongful death.

How Do I Prove Negligence?

In order to be the winner in a case based on negligence, you will have the burden of proving four different things to establish liability.

  • Duty: The defendant owed you a duty of care
  • Causation: The defendant’s conduct was the direct and proximate cause of your injury
  • Damages: You suffered damages as a result (e.g., physical injuries, financial charges).

This might seem straightforward, but proving negligence can be quite challenging. It’s best to trust an experienced lawyer to take charge and create a strong case on your behalf.

Will My Personal Injury Case Go to Trial?

Statistically speaking, probably not. Only 4 or 5% of civil personal injury lawsuits end up in court. However, that doesn’t mean that your case won’t. The insurance provider might not offer you a fair settlement, or the at-fault party might just refuse to negotiate with you, at all.

Whether your case ends up in court or not, you’ll want to hire a lawyer experienced in courtroom litigation. This will show the defendant that you will not be pushed around or manipulated into taking anything less than a fair deal.

If an insurer knows your attorney is a winning litigator, they’re more likely to deal with you in good faith and negotiate fair terms.
