Steps To Take After an NYC Car Crash

If you are involved in an auto accident in NYC, New York, here are the steps you must follow to protect your health and your legal rights:

Pull Over

It is illegal to leave the scene of a crash without exchanging information with the other involved driver(s). If you fail to stop, you could be charged with a hit-and-run.

Check For Injuries and Report the Accident

Check yourself and ask your passengers about any injuries. Check on the occupants of the other vehicle(s), too. New York law requires you to report the crash immediately to the police if the accident resulted in any injury.

Seek Medical Attention

If anyone was injured, ask for an ambulance when you report the accident. Even if you don’t notice symptoms right away, seek prompt medical attention, such as by visiting an urgent care center.

File an Insurance Claim

Because New York is a no-fault insurance state, you will first turn to your own personal injury protection (PIP) insurance provider for coverage following an accident, regardless of fault. This is likely the first insurance claim you will file, and you need to file your claim within 30 days to preserve your right to collect under your policy.

PIP benefits include payment up to $50,000 for the driver and their passengers for the following losses:

  • All reasonable and necessary medical expenses, according to established fee schedules
  • 80% of lost earnings from work, up to a maximum payment of $2,000 per month, subject to certain offsets
  • Up to $25 per day to reimburse you for other reasonable and necessary expenses, such as transportation costs to and from medical appointments and household help
  • A $2,000 death benefit

If you suffered a serious injury, you could also pursue compensation from the at-fault party.

New York insurance law defines a serious injury as a personal injury that results in any of the following:

  • Death
  • Dismemberment
  • Significant disfigurement
  • Fracture
  • Loss of a pregnancy
  • Permanent loss or consequential limitation of use of a body organ, member, function, or system
  • Significant limitation of use of a body system or function
  • A temporary injury or impairment that prevents you from performing substantially all activities of daily living for at least half of the 180 days following the accident

If you can step outside the no-fault system, you can pursue compensation for all of your losses, including the full amount of your lost earnings and non-economic damages.

Maintain Records

You will likely start amassing a lot of letters, medical records, and other documents related to the accident.

Keep all of the accident-related records you have, including the following:

  • Pictures of the accident scene
  • Letters from insurance companies
  • Medical bills
  • Doctor’s notes
  • Imaging test results
  • Pay stubs
  • Receipts for rideshare services, taxis, or subway fare
  • Property repair estimates

Give all of this information to your New York City car accident lawyer.
